Terms & Conditions

Welcome to Austin City Photo Booth (“Company,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website austincityphotobooth.com (the “Site”) and your booking or use of our photo booth, video, and event activation services (the “Services”). By accessing our Site or booking our Services, you agree to be bound by these Terms.

1. Services

Austin City Photo Booth provides interactive photo and video activations, including but not limited to Photo & GIF Booths, Virtual Booth, Studio360, Digital Graffiti Wall, and Custom Experiences, for weddings, corporate events, brand activations, and social gatherings. Specific package inclusions, hours of operation, and add-ons will be outlined in your individual booking agreement/quote.

2. Bookings, Quotes, and Payment

• All bookings are subject to availability and are only confirmed upon receipt of a signed agreement/quote and any required deposit.
• A non-refundable retainer/deposit may be required to reserve your event date. The remaining balance is due according to the schedule specified in your booking agreement, generally prior to the event date.
• Prices quoted are valid for a limited time and are subject to change until a booking is confirmed with a deposit.
• Accepted payment methods will be specified at the time of booking.

3. Cancellations and Rescheduling

• Cancellations must be submitted in writing (email or written notice) to info@austincityphotobooth.com.
• Deposits/retainers are non-refundable under any circumstances, as they secure your event date and are used to cover administrative and scheduling costs.
• Rescheduling requests will be accommodated where possible, subject to availability, and may be subject to additional fees.
• We reserve the right to cancel or reschedule a booking due to circumstances beyond our control (see Force Majeure below), in which case we will work with you to find a mutually agreeable solution, including rescheduling or a partial/full refund at our discretion.

4. Client Responsibilities

• The client is responsible for providing accurate event details (date, time, location, venue access, power supply, and space requirements) in advance of the event.
• The client must ensure adequate space, a stable and level surface, and access to a standard power outlet for the booth setup, unless otherwise arranged.
• Any delays caused by inadequate venue access, power availability, or space may result in reduced service time without refund.
• The client is responsible for obtaining any permits or venue permissions required for our equipment/attendants to operate on-site.

5. Equipment, Attendants, and Conduct

• Our photo booths and equipment remain the property of Austin City Photo Booth at all times.
• Our attendants are trained professionals who will operate and manage the booth throughout the event. Clients and guests are expected to treat our staff and equipment respectfully.
• The client is financially responsible for any damage to our equipment caused by guests’ intentional misuse, negligence, or abuse during the event.
• We reserve the right to suspend service in situations involving unsafe conditions, abusive behavior, or misuse of equipment.

6. Photo, Video, and Marketing Use

Unless otherwise agreed in writing prior to the event, Austin City Photo Booth retains the right to use photos, videos, and GIFs captured during your event for portfolio, marketing, advertising, and promotional purposes, including on our website, gallery, and social media channels. Guests who use our on-site social sharing feature do so voluntarily and are responsible for their own sharing activity on third-party platforms.

7. Intellectual Property

All content on our Site, including text, graphics, logos, images, and software, is the property of Austin City Photo Booth or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our Site content without our prior written consent.

8. Limitation of Liability

• To the fullest extent permitted by law, Austin City Photo Booth shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Services, including but not limited to loss of enjoyment, event delays, or dissatisfaction with photo/video output.
• Our total liability for any claim arising from our Services shall not exceed the total amount paid by the client for the Services in question.
• We are not responsible for delays or service interruptions caused by circumstances beyond our reasonable control, including venue issues, technical malfunctions, weather, or acts of third parties.

9. Force Majeure

Austin City Photo Booth shall not be held liable for failure to perform its obligations if such failure results from acts of God, natural disasters, extreme weather, government restrictions, pandemics, power outages, venue closures, or other events beyond our reasonable control. In such cases, we will make reasonable efforts to reschedule or otherwise resolve the matter with the client.

10. Indemnification

The client agrees to indemnify and hold harmless Austin City Photo Booth, its owners, employees, and attendants from any claims, damages, losses, or expenses arising out of the client’s or their guests’ use of our Services, violation of these Terms, or violation of any rights of a third party.

11. Website Use

You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. We reserve the right to restrict or terminate access to the Site for any user who violates these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Travis County, Texas.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of our Site or Services after changes are posted constitutes acceptance of the revised Terms.
